What is the difference between Pixsy’s Licensing and Legal Resolution Program?

When Pixsy reviews and accepts your case, your case will be accepted to either our Licensing or Legal Resolution Program.
In our Licensing Resolution Program, a Case Manager contacts the Image User directly to negotiate a retroactive license fee for the historic use of your work. If you’ve submitted the case and check-marked that you authorize us to license the work for continued use, we may negotiate a continued use license in exchange for a higher fee.
Licensing allows us to assist our clients on a wide variety of cases, and to engage Image Users directly in fair licensing practices. It’s our experience that the majority of Image Users are not aware that they’ve used work without authorization, and with some education take meaningful steps towards resolution.
Our Legal Resolution Program has stricter requirements for case acceptance, and only select cases are accepted. Cases that are accepted must meet set criteria that we define with our legal partners in accordance with local case law.
Common elements of cases accepted to Pixsy’s Legal Resolution Program include:
- Work that is registered with an international copyright office
- History of high-value licensing (for online use)
- Work that is published under an All Rights Reserved license (not Creative Commons)
- The work is used by an established commercial company, that has healthy financial accounts in a local business ledger
