Yes. In cases where an Image User does not comply with our Legal Partner’s settlement demand or engage in settlement negotiations are individually reviewed for further escalation. At this stage, the only recourse to resolve your case is to file a lawsuit, and it is our experience that most lawsuit cases settle soon after filing.
Common elements of cases that are recommended for a lawsuit include/involve:
- Work that is registered with an international copyright office
- History of high-value licensing (for online use)
- Work that is published under an All Rights Reserved license (not Creative Commons)
- The work is used by an established commercial company, that has healthy financial accounts in a local business ledger
